Terms of Service

Please read these Terms of Service ("Terms") carefully before using our software applications, mobile progressive application, and local matching services (collectively, the "Services") operated by JobDiary Ltd ("us", "we", or "our").

By accessing or using our Services, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not use the Services.

1. Service Eligibility and Registration

To register for a JobDiary contractor account, you must be a sole trader or run a registered trade company in the United Kingdom. You are responsible for maintaining the security of your account and session credentials. You must notify us immediately of any unauthorized access to your account.

2. Use of Services & Professional Conduct

JobDiary is a management helper tool. You represent and warrant that:

• Any quotes, contracts, or invoice records generated by you represent legal, accurate, and fair agreements with your clients.
• You will not use our platform to send fraudulent payment links or spam clients via WhatsApp.
• For the SendSomeone service, you will not post fake jobs or harvest tradesmen contact info without a genuine service requirement.

3. Fees, Subscription, and Cancellation

• Subscriptions: Paid subscription plans are billed in advance on a monthly rolling basis.
• Trials: Paid plans start with a 30-day free trial. If you do not cancel before the end of the trial, your payment card will be charged.
• Cancellation: You can cancel your subscription at any time. Upon cancellation, your account will revert to our Free Plan, preserving your active data up to the free limits.

4. Digital Signatures and Binding Agreements

JobDiary provides digital contract signing templates. Contracts signed through our WhatsApp portal are legally binding under the UK Electronic Communications Act 2000. JobDiary Ltd is not a party to any contracts signed between you and your clients and assumes no liability for disputes arising from your client agreements.

5. Limitation of Liability

To the maximum extent permitted by UK law, JobDiary Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, resulting from your use of or inability to use the Services.

6. Governing Law

These Terms shall be governed and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.
